1. Acceptance of Terms

By accessing your NestFoundry personalized home page or subscribing to our service, you agree to these Terms of Service and our Privacy Policy. If you do not agree, do not use our service.

2. Description of Service

NestFoundry provides AI-generated home staging visualizations ("renders") for recently sold residential properties in Florida, delivered to the new homeowner via a personalized private URL. Our service includes AI render generation, curated affiliate product recommendations, and optional premium subscription tiers.

3. Rights Attestation (Property Photo Authorization)

IMPORTANT — Please read carefully

By proceeding through NestFoundry's authorization flow, you attest that you are the legal owner or authorized representative of the property shown, and that you authorize NestFoundry to use publicly listed photos of your property solely for generating personalized AI staging renders for your personal use.

The authorization you grant is:

  • Limited to generating AI renders for your personal viewing only
  • Revocable at any time by contacting us at legal@nestfoundry.io
  • Subject to automatic expiration per the retention schedule in our Privacy Policy
  • Not a transfer of any intellectual property rights

4. User Conduct

You agree not to:

  • Share your private token link publicly or with unauthorized parties
  • Use AI renders for commercial purposes without a commercial license
  • Attempt to reverse-engineer, download in bulk, or scrape our service
  • Impersonate another property owner to access their personal landing page
  • Use the service for any unlawful purpose

5. Subscription and Payment

  • Free tier: Includes 1 AI render, watermarked, 14-day gallery. No credit card required.
  • Starter ($29/mo): 3 renders, no watermark, 30-day gallery, full affiliate catalog.
  • Pro ($79/mo): 5 renders, priority queue, LoRA style specialization.
  • Agency ($199/mo): Unlimited renders, white-label, API access.
  • All paid subscriptions are billed monthly via Stripe. You may cancel at any time.
  • Refunds: We offer a full refund within 14 days of first payment if you are unsatisfied. Contact billing@nestfoundry.io.
  • Special Furniture Refund Program: If you purchase $2,000+ in furniture via our affiliate links within 90 days of subscribing, you may apply for a $200 setup fee rebate. See our Refund Policy for details.

6. Intellectual Property

AI-generated renders are provided for your personal use. You may not reproduce, distribute, or commercialize renders without a commercial license. NestFoundry retains all intellectual property rights in our platform, AI models, and software. Original listing photos remain the property of their respective copyright holders.

7. Affiliate Disclosures

NestFoundry participates in affiliate programs with Wayfair, Overstock, Amazon Associates, and other retailers. We may earn a commission when you purchase products via our links. This does not affect our product recommendations or the price you pay. All affiliate relationships are disclosed in compliance with FTC guidelines.

8. Disclaimer of Warranties

THE SERVICE IS PROVIDED "AS IS" WITHOUT WARRANTY OF ANY KIND. NESTFOUNDRY DOES NOT WARRANT THAT AI RENDERS WILL ACCURATELY REPRESENT YOUR HOME, THAT THE SERVICE WILL BE UNINTERRUPTED, OR THAT AFFILIATE PRODUCTS WILL MEET YOUR EXPECTATIONS. AI RENDERS ARE VISUALIZATIONS ONLY — NOT ARCHITECTURAL PLANS OR INTERIOR DESIGN ADVICE.

9. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY FLORIDA AND APPLICABLE LAW, NESTFOUNDRY'S LIABILITY TO YOU SHALL NOT EXCEED THE GREATER OF $100 OR THE AMOUNTS PAID BY YOU IN THE LAST THREE MONTHS. WE ARE NOT LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, OR CONSEQUENTIAL DAMAGES.

10. Indemnification

You agree to indemnify and hold harmless NestFoundry, its officers, directors, and employees from any claims arising from: (a) your use of the service; (b) your violation of these terms; (c) your attestation that you are authorized to use property photos. This clause is subject to applicable Florida consumer protection law.

11. DMCA

NestFoundry complies with the Digital Millennium Copyright Act (17 U.S.C. § 512). If you believe material on our platform infringes your copyright, contact our DMCA agent at dmca@nestfoundry.io. We will process valid notices within 24 hours.

12. Governing Law

These terms are governed by the laws of the State of Florida, USA, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Orange County, Florida.

13. Changes to Terms

We reserve the right to modify these terms. Material changes will be communicated via email (if you have provided an address) or by prominent notice on our website. Continued use after changes constitutes acceptance.
